Licensing Hearings

Prelim Process

PRELIM applicant is a NEW HIRE applicant who is interested in a position that requires a gaming license and has one or more of the below listed offenses. This process will STREAMLINE the Legislative Waiver Hearing process for applicants who answer “YES” to the below question. 


DO YOU HAVE ANY OF THE BELOW OFFENSES?  

  • Any felony conviction within the ten (10) years prior to the application.  
  • Any conviction for any gaming-related offense.  
  • Any conviction for fraud, misrepresentation, theft, or deception in any form or connection  within the ten (10) years prior to the application.  
  • A violation of any provision of Wis. Stats., Chs 562 (racing/on-track pari-mutuel wagering) or  565 (State Lottery), this Ordinance, or any other Tribal law regulation or prohibiting gaming.

OVERVIEW: GENERAL PROCESSES FOR IDENTIFIED LICENSING VIOLATIONS

The Gaming Commission and the Legislature each have specific jurisdictional authority to hold hearings and hear testimony. The type of violation(s) identified in your background will determine which jurisdictional body is authorized to hold the hearing. You may exercise your right of due process by requesting such a hearing. Only under certain conditions may a person appeal a Gaming Commission decision; such person must initiate their appeal in a timely matter at the Ho-Chunk Nation Trial Court in Black River Falls, Wisconsin.
